Acceptance of Terms

By accessing or using AI Wallpaper ("the Service") at aiwallpaper.best, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use the Service.

Description of Service

AI Wallpaper is an AI-powered wallpaper generation service that allows users to create custom wallpapers using text prompts and AI image generation models. The Service operates on a credit-based system where users purchase credits to generate wallpapers.

User Accounts

  1. Registration: You must create an account to use the Service. You agree to provide accurate and complete information during registration.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. Account Verification: We may verify your email address and account information to prevent fraud.

Credits and Payments

  1. Credit System: Each wallpaper generation costs a fixed number of credits (currently 2 credits per generation). Credits are deducted upon successful generation.

  2. Purchasing Credits: Credits can be purchased as one-time packs or through monthly/yearly subscriptions. All prices are listed in USD.

  3. Credit Expiration:

    • One-time credit packs: Credits do not expire.
    • Subscription credits: Credits are allocated per billing period and may expire at the end of each period.

  4. Subscription Terms:

    • Subscriptions automatically renew at the end of each billing period.
    • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
    • Unused credits from the current billing period remain available until they expire.

  5. Payment Processing: Payments are processed through our third-party payment provider (Creem). We do not store your full credit card information.

User Content and AI Generation

  1. Your Prompts: You are solely responsible for the text prompts you submit and any images you upload. You must not submit content that:

    • Violates any applicable law or regulation
    • Infringes on the intellectual property rights of others
    • Contains explicit, violent, hateful, or harmful material
    • Depicts real individuals without their consent
    • Is intended to generate misleading or deceptive content

  2. AI-Generated Outputs: AI-generated wallpapers are created by third-party AI models. You acknowledge that:

    • Results may vary and are not guaranteed to meet specific expectations
    • AI-generated content may inadvertently resemble existing copyrighted works
    • You are responsible for verifying that generated content is appropriate for your intended use
    • We do not claim ownership of AI-generated outputs you create

  3. Uploaded Images: If you upload images for reference or image-to-image generation:

    • You must have the right to use those images
    • Uploaded images are stored securely and associated with your account
    • You may delete uploaded images from your account at any time

Prohibited Uses

You agree not to:

  • Use the Service to generate illegal, harmful, threatening, abusive, or defamatory content
  • Generate content that exploits or harms minors
  • Attempt to reverse-engineer, decompile, or extract the AI models used by the Service
  • Share your account or credits with others
  • Use automated tools to access the Service in an unauthorized manner
  • Resell or redistribute generated wallpapers in a way that competes with the Service
  • Use the Service to generate content that infringes on third-party rights

Intellectual Property

  1. Service Ownership: The AI Wallpaper platform, including its design, code, and infrastructure, is owned by AI Wallpaper and protected by intellectual property laws.

  2. User-Generated Content: You retain ownership of your text prompts and uploaded images. AI-generated outputs are available for your personal or commercial use as indicated in your purchased plan.

  3. License Grant: By using the Service, AI Wallpaper grants you a limited, non-exclusive license to use generated wallpapers for the purposes permitted by your plan.

Refund Policy

  1. One-Time Purchases: Credit pack purchases are generally non-refundable once credits have been used. Unused credits from one-time packs may be eligible for refund within 7 days of purchase.

  2. Subscriptions: You may cancel your subscription at any time. We do not provide partial refunds for unused portions of a billing period. Subscription fees for the current period are non-refundable.

  3. Technical Issues: If you experience a technical issue that results in failed generations without credit deduction, please contact support. We will investigate and may issue credit refunds at our discretion.

Service Modifications

We reserve the right to:

  • Modify credit costs, pricing, or subscription plans with reasonable notice
  • Change, suspend, or discontinue any aspect of the Service
  • Update the AI models used for generation
  • Modify features or functionality

We will make reasonable efforts to notify users of material changes.

Termination

We may suspend or terminate your account if:

  • You violate these Terms of Service
  • Your account is inactive for an extended period
  • Required by law or legal process

You may terminate your account at any time by contacting support or through your account settings.

Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding:

  • The quality, accuracy, or suitability of AI-generated wallpapers
  • Uninterrupted or error-free operation of the Service
  • The results obtained from using the Service

Limitation of Liability

To the maximum extent permitted by law, AI Wallpaper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes are posted constitutes acceptance of the updated Terms.
